Terms and Conditions

These are the terms and conditions (the "Terms") on which we supply our Services to you. Please read these Terms carefully before you submit your request for Services to us. These Terms tell you who we are, how we will provide Services to you, how you and we may change or end the contract, what to do if there is a problem and other important information.

    • If we must contact you, we will do so by telephone, SMS text or by writing to you at the email address you provided to us in your request for Services.
    • When we use the words "writing" or "written" in these Terms, this includes emails and messages sent through our website.
    • When we use the term "Tutor" or 'Service professional' in these Terms, this means a person introduced by us to you, to be engaged by you as a tutor or to provide other skilled services.
    • When we use the term "engagement" or "engage" or "engaged" in these Terms, this means the engagement (including the Tutor's acceptance of your offer), employment or use of the Tutor by you or by any third party to whom you have introduced the Tutor.
    • When we use the terms "introduction", "introduce" and "introduced" in these Terms, this means the passing of a curriculum vitae (CV) or information about the Tutor to you, or the interview of a Tutor by you, whether in person, by telephone or by any other audio or visual means and, in either case, which leads to the engagement of the Tutor.
    • Please note that these Terms may change from time to time, but we will always endeavor to provide you with notice if they do change. You should also review our website periodically to see whether any changes have been made to these Terms.
2. Our Services
  • Tugah Services, as an educational service and employment agency, introduces Tutors or Service Professionals to clients for tuition purposes, specific projects, and technical learning opportunities.

    • A shortlist of suitable Tutors or professionals will be provided following a request, and clients may contact Tutors or Service Professionals for further engagement.
    • Tugah Services also offers coding bootcamps and technical learning programs, including teaching programming languages such as Python, Java. These programs are designed to equip individuals with essential skills for their professional development.
    • In addition to tutoring, we provide application support services, assisting individuals with their applications to higher education institutions.
    • Tutors or service professionals are responsible for arranging lesson schedules and requesting necessary background information from clients.
    • Tutors provide teaching and learning resources directly to clients, and Tugah Services does not supply these materials.
    • Lessons can take place at the client's home, school, online, or at another agreed location.
3. Fees
  • Tugah Services brokers a competitive rate between the Client and the Tutor or Service Professional.
  • No registration fees are required up front for using our platform.
  • The total fee paid by the Client includes the cost of tuition or providing a service, plus the Platform and Service Administration fee.
  • After each Lesson, the Tutor submits a timesheet to Tugah Services for approval by both Tugah Services and the Client, detailing the Lessons taught.
  • Clients are responsible for paying all fees directly to Tugah Services, and Tugah Services will ensure payment distribution to Tutors or Service Professionals.
4. Payment Information
  • Payment for the first, trial lesson is payable either via Bank Transfer after the lesson, by cash directly to the designated personnel of Tugah Services or credit/debit card payments can be made over the phone.
  • If the client is happy to continue with tuition after the initial trial session, payment is due based on agreed payment frequency terms with clients.
  • Tutors or service professionals are employed by Tugah Services. Therefore, payments should not be made directly to the tutor or service professional because this will cause increased administration for payroll.
  • Clients of Tugah Services agree not to approach tutors introduced by Tugah Services directly or indirectly with competing work proposals, as this would result in a breach of contract for the tutors. If clients bypass Tugah Services and engage tutors directly for tuition, they will remain liable for all tuition fees owed to Tugah Services for the duration of the tuition.
5. Termination of tuition
  • This Agreement may be ended by mutual consent at any time, or
  • Either signatory to this Agreement may terminate the Agreement by giving notice in writing by mail to the other signatory at least a week in advance.

6. Complaints
  • It is important that all clients are happy with the service that they receive, and tutors employed by Tugah Services are closely monitored.
  • After the first session, Tugah Services will call you to ensure that you were satisfied with the service provided, and to ask for any feedback.
  • In the unlikely event that you are unhappy with the tuition service provided at any point, please call or email support@tugahservices.com as soon as any issue arises, and we will attempt to resolve any issues. In the case of an irrevocable break-down in the relationship between the Client and their Tutor, the assigned Tutor may be replaced, if another suitably qualified Tutor is available and if the replacement tutor is acceptable to the client.
7. Lesson Cancellation
  • To cancel a scheduled lesson, please give notice at least 24 hours in advance. Failure to provide at least 24 hours' notice will result in the time being invoiced apart from where there has been a death in the family.
  • If a cancellation is made with more than 24 hours' notice, an alternative tuition time will be offered, though the client must accept that it may not always be possible to accommodate rescheduling of lessons, in which case the lesson will be missed, and no invoice will be given in respect to the session.
  • Cancellation with less than 24 hours' notice due to student illness will be invoiced.
  • Cancellation with less than 24 hours' notice due to tutor illness will not be invoiced, but the opportunity for a session at a mutually convenient alternative time will be arranged as soon as possible.
  • Cancellation with more than 24 hours' notice on either side will not be invoiced
8. Make-up Lessons
  • If the tutor is unable to give a scheduled lesson, an alternative time will be offered where possible.
  • If the student is unable to attend a scheduled lesson, every effort will be made to provide a make-up lesson if proper notice is given.
9. Lateness
  • Lessons will start at their scheduled time.
  • Where tutors are travelling to students, students should be ready to start their lesson at the allocated time. However, it should be appreciated that where tutors are travelling to students there may, on occasion, be unavoidable delays due to traffic, extended communication with parents etc. Where lessons start after their scheduled time due to tutor lateness, the time will be made up.
  • Tutor lateness in excess of 15 minutes will be communicated by text message as soon as is reasonably practicable.
10. Lesson Requirements
  • Students should bring the following items to every lesson: books they are currently working out of, notebooks/paper, calculator and appropriate stationery.
  • Students should come to each lesson with any homework set by the tutor, completed and be ready to discuss what they are working on.
11. Code of Conduct
  • When tuition takes place in the client's home, students, parents and other residents are requested to refrain from smoking inside the designated location in the house where tuition takes place for the duration of the lesson.
  • Where students are under 18, tuition will only take place where a responsible adult is always in the house. If a responsible adult is not home for the full duration of the lesson, the lesson will be terminated or will not start, but the full lesson fee will be payable.
  • Where tutors are travelling to students, students and adult members of the household should be properly dressed in daytime clothes on arrival (not pyjamas). It is appreciated that this may not be appropriate or feasible for younger members of the household, where sessions are held after 8pm.
  • Where tuition will take place at the clients' home, space should be provided for tuition where the responsible adult can always be accessible. Under no circumstances will tuition take place in a bedroom.
  • Students and their parents are to refrain from using inappropriate, disrespectful or aggressive language and/or behavior during, before or after lessons. Aggressive or threatening behavior will result in immediate termination of the tuition agreement. Any fees paid for future lessons will be forfeited. The first offense will result in a verbal warning.
  • The second offense will result in a written warning.
  • The third offense will result in automatic withdrawal from lessons with the tutor. In this case, the payment schedule will revert for the case of termination without notice.
12. Limitation of Liability
  • While the Tutor will endeavor to ensure the student makes satisfactory progress or work towards achieving targets for Test Preps, this cannot be guaranteed, and neither the Tutor, nor Tugah Services can be held accountable for the academic success or otherwise of the student.
  • To the maximum extent permitted by law, neither the Tutor, nor Tugah Services accept liability for any direct or indirect loss or damage, foreseeable or otherwise, including any indirect, consequential, special or exemplary damages arising from the use of the Tutor's or Tugah Services or any errors or omissions in the content of the Tutor's learning materials.
